Government fees: The basic government fees for a trademark registration in Canada are always $450 in total: $250 when the trademark application is filed, and $200 at the end of the application process upon registration of the trademark. There are no ‘classes’ in Canadian trademark law, and thus the application fee is always the same.
Additional government fees apply for steps outside the basic application process, including extensions of time, oppositions, etc.
The cost to file a Canadian trademark application using our firm as your trademark agent is $750 (plus applicable taxes for Canadians on our service fees – not taxes applied to the government fees). This includes the government fee. The total cost of securing a Canadian trademark registration, from application to registration including government fees, is usually $1750-$2000 for an uncontentious application (no opposition, etc.), incurred over 12-18 months (this estimate includes the $750 on filing, plus $750-$1250 incurred later). We offer a guaranteed flat fee of $1850 for qualified applications.
Other people charge by the hour for trademark applications. We don’t. We only charge our quoted flat fees.
Do-it-yourself: You may also draft the the mark application yourself using our online Canadian trademark application form and have it filed by us with or without a review (our fees: $85/$135 for a total cost including government fees of $335/$385). If you are not a Canadian, you must also designate either a trademark agent or representative for service in Canada. Our fees to act as representative for service are $100.
Of course, other government and agency fees apply to other steps such as filing assignments, oppositions, etc.

For Canadian trademark matters the total cost is composed of two separate costs:
- The government fees (if any); and,
- Our agency fees.
For a Canadian trademark application the government fee to file the application will always be $250. There are no classes in Canadian trademark practice (learn more about descriptions of goods/services in Canadian trademarks here) and accordingly, the filing fee is always this same amount of $250. A subsequent government fee of $200 is payable upon registration.
Our fees to assist you draft and file the application are $500 (plus GST/HST if applicable – no taxes for clients outside Canada). A properly prepared application will save you significant amounts of time and money. A badly drafted application is worse than worthless: the application will be rejected and you will lose the $250 government filing fee.
